The Court Hearing Is Informal
Instead of a judge, the hearing takes place in front of a clerk magistrate. Generally, the officer who wrote the ticket will not attend, but another officer will be there to represent the police department. Here, you will have the opportunity to present your case. If you feel it is necessary, you may bring witnesses, photos, and other supporting information. The clerk magistrate will make a decision based on the evidence. Should the clerk magistrate rule against you, you can appeal and have your case be heard by a judge.
